Safety training and education
- 1926.21(b)(2) The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.

- 1926.32(f) “Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them

§ 630.1008 State-level processes and procedures.
(d) Training. States shall require that personnel involved in the development, design, implementation, operation, inspection, and enforcement of work zone related transportation management and traffic control be trained, appropriate to the job decisions each individual is required to make. States shall require periodic training updates that reflect changing industry practices and State processes and procedures.

MUTCD - Section 6B.01 Fundamental
Principles of Temporary Traffic Control
Individuals who are knowledgeable (for example, trained and/or certified) in the principles of proper TTC should be assigned responsibility for safety in TTC zones.
Each person whose actions affect TTC zone safety, from the upper-level management through the field workers, should receive training appropriate to the job decisions each individual is required to make. Only those individuals who are trained in proper TTC practices and have a basic understanding of the principles (established by applicable standards and guidelines,including those of this Manual) should supervise the selection, placement, and maintenance of TTC devices used for TTC zones and for incident management.

MUTCD Section 6D.03 Worker safety considerations
- A. Training—all workers should be trained on how to work next to motor vehicle traffic in a way that minimizes their vulnerability. Workers having specific TTC responsibilities should be trained in TTC techniques, device usage, and placement.
- B. Worker Safety Apparel—A competent person designated by the employer to be responsible for the worker safety plan within the activity area of the job site should make the selection of the appropriate class of garment.

FLAGGER CONTROL
Because flaggers are responsible for public safety and make the greatest number of contacts with the public of all highway workers, they should be trained in safe traffic control practices and public contact techniques.

105-02 CHARACTER OF WORKERS
All workers engaged on special or skilled work shall have had sufficient experience in such work to properly and satisfactorily perform it and operate the equipment involved. Any person employed by the Contractor whom the Engineer may deem unruly, disorderly, incompetent or unfit to perform the work shall be at once discharged, and shall not be again employed.

NYSDOT Night Work Training
Traffic Control Supervision. The Contractor shall provide a full-time traffic control supervisor for nighttime operations with adequate training, experience, and authority to implement and maintain all traffic control operations.
Trained Flaggers. All flaggers used in nighttime operations shall be formally trained in flagging operations.

NYSDOT – Lead safety training
Lead Safety and Health. The Contractor shall provide worker lead protection in accordance with 29 CFR 1926.62. The Contractor shall provide to the Engineer a written Lead Compliance program addressing as a minimum the specific issues listed in 29 CFR 1926.62 (e)(2), a written Hazard Communication program and Worker Lead Training program as components of the Project Safety and Health Plan.
